Title: WORKERS' COMPENSATION CLAIM SETTLEMENT

Description:

  • The settlement of this claim was recommended by the District’s outside counsel and claim adjusters and has been approved by the Chief Counsel, Chief Financial Officer and Director of Employee Benefits & Risk Management as required by District Policy #6.09.

 

  • A 44-year-old Paraprofessional sustained injuries to the back, neck and jaw on 6/8/94 when rowdy students injured her and on 9/13/94 when she slipped and fell in the cafeteria. She was ultimately accepted as permanent and total disability with between 9% and 11% disability ratings.

 

  • The District has paid over $240,000 of its $500,000 retention with a future estimate of over $370,000 to include medical and indemnity.  This includes treatment for TMJ, depression along with a host of other injuries to the back and neck including fibromyalgia and RSD.

 

  •  The settlement has been agreed upon pending Board Approval.  The settlement will extinguish all future liabilities.

Recommendation:

I recommend that the School Board approve the settlement of the following Workers’ Compensation claim in the amount of $170,000 for AA, Claim Number 115729, representing compensation, attorneys’ fees and costs and authorize the execution of all related documents. 

Financial Impact:

The financial net impact to the District for this settlement is $170,000.  The source of funds is the General Fund.
