Title: (C) - Agreement - Devereux Foundation

Description:

An Individual Education Plan (IEP) team met on August 5, 2004, and determined that the student requires placement in a residential facility due to severe behavioral and emotional issues as a result of a traumatic brain injury.  The student had previously been placed in a regular day school, an intensive alternative education program, and a charter school for students requiring specialized transitional vocational services.  During the past two years the School District has provided tutoring, behavior therapy, and family support, in addition to the regular day program.  The School District has also worked closely with the Brain and Spinal Cord Injury Association of Florida to coordinate services to the student and family.

On August 9, 2004, the School Board approved a contract with the facility to provide services to the student through December 2004.

The student attended the facility for only one day in August 2004 and was withdrawn by parents. On November 12, 2004, the District agreed, at the parents' and student's request and pursuant to the current IEP, that the student could return to the facility on December 9, 2004.

Since the IEP is written for one year, and the student only attended the program for less than one month during the first semester of the current school year, the placement in the residential facility will continue through June 30, 2005.

District staff will make on-site visits to the facility prior to the conclusion of the current contract to review the student's progress and consider future placement options.  A follow-up IEP team meeting will convene no later than May 2005 to determine the future placement for this student.

The District will pay for this student's services for only those days the student is physically present and in attendance at the facility. The cost of the contract for the entire school year, had the student attended for the entire school year, would have been $92,857.  The cost of the contract for the remainder of the current fiscal year (Januray 1 through June 30, 2005) will be $53,144.

The FTE earned by this student during this school year will be $10,740.39, which is one-half of the total FTE that would have been earned had the student been enrolled during the October FTE survey.

This cooperative agreement is in compliance with State Board Rule 6A.6-0361, "Special Programs for Contractual Agreements with Non-Public Schools."

Recommendation:
I recommend that the School Board approve this confirming cooperative agreement with Devereux Foundation.  The cost of the confirming cooperative agreement is $53,144, effective January 1, 2005, through June 30, 2005.

Financial Impact:
The financial impact to the District's general operating fund is $53,144.  The source of the funds is the Exceptional Student Education Department budget.
