NOTICE OF RULE DEVELOPMENT
AND PUBLIC HEARING

RULE TITLE: Resignation and Termination of Employment.

RULE NUMBER: Policy 3.20.

SUBJECT AREA TO BE ADDRESSED: The process for resignation or termination of employment.

PURPOSE AND EFFECT: This revision will update the process for resignation or termination, including the requirement to file form PBSD 1176 (“Employee Resignation/Termination”) with the principal or department head. Form PBSD 1176 is incorporated by reference. A new subsection concerns terminal retirement benefit for compensation for unused sick leave for employees who resign, terminate, or retire with a minimum of six years of service employment. Other new sections govern unused annual leave, and unused sick leave for employees who are not covered by a collective bargaining agreement. If the provisions of a collective bargaining agreement conflict with this Policy, the provisions of the collective bargaining agreement will prevail.

PUBLIC HEARING NOTICE: Development of the proposed rule is anticipated to be considered at the School Board's Special Meeting on Policies on December 5, 2007, anticipated to begin at 3:30 p.m. (an approximate time, as the actual start time may vary earlier or later) in the Board Chambers at 3300 Forest Hill Blvd., West Palm Beach, Fla. AGENDA: An agenda will be available by November 28, 2007 on the District's Web site. Pursuant to the provisions of the Americans with Disabilities Act, any person requiring special accommodations to participate in this hearing is asked to advise the agency at least 48 hours in advance by contacting the Board clerk at 434-8139. A person may submit written comments (12 copies) about the proposed action to the clerk no later than the time of the public hearing. This hearing is open to the public.
