NOTICE OF PROPOSED RULE DEVELOPMENT & PUBLIC HEARING

RULE TITLE: Student Reassignment.

RULE NUMBER: Policy 5.015.

SUBJECT AREA TO BE ADDRESSED: Handling requests for reassignment to a school other than the one to which a student is assigned based on the zone of residence.

PURPOSE AND EFFECT: To codify as a rule the District’s practices and procedures for handling requests for reassignment on various listed bases. This new Policy will supersede Directive D-5.04 and will recognize that some students may legitimately reside with a person who is acting as a parent in the absence of the parent, and that person’s residence address can be the basis for reassignment. In general, the Department of Choice Programs and School Choice must verify that the proposed receiving school has not reached 100% of FISH capacity before allowing a reassignment request. Reassignment will not be allowed, regardless of the level of service, when: the school is a new facility in its first school year; construction-related issues exist, leading to crowding on the campus; or special programs at the school lead to lack of available classrooms. Moreover, a reassigned student may be required to return to the original school for reasons such as: the student becomes a discipline problem at the receiving school by committing a Level 3 or Level 4 infraction; or the student demonstrates a substantial attendance problem at the receiving school.

PUBLIC HEARING NOTICE: Development of the proposed rule is anticipated to be considered at the School Board's Special Meeting on Policies on March 29, 2006, anticipated to begin at 4:00 p.m. in the Board Chambers at 3300 Forest Hill Blvd., West Palm Beach, Fla. If time limitations preclude hearing this proposal on March 29, it may be heard at the special meeting on April 5, 2006, anticipated to begin at 3:15 p.m. in the Board Chambers at 3300 Forest Hill Blvd., West Palm Beach, Fla.  AGENDA: A copy of the agenda will be available by March 22 on the District's Web site.
