NOTICE OF PROPOSED RULE DEVELOPMENT & PUBLIC HEARING

RULE TITLE: Settlements of Claims, Lawsuits, and Workers Compensation Matters.

RULE NUMBER: Policy 6.09.

SUBJECT AREA TO BE ADDRESSED: Delegation of authority to settle matters such as auto, general liability, workers compensation, personnel, labor relations, and certain other claims and suits under certain monetary limits.

PURPOSE AND EFFECT: With certain stated exceptions, proposals for settlements/offers of judgment or settlement proposals for pending or threatened litigation or claims may be accepted, and/or offered and processed for payment up to specified monetary limits, by specified administrators provided they have determined that such offer or acceptance will be in the best interests of the School Board upon consideration of factors listed in Section 5 of the revised Policy and after consultation with the Office of Chief Counsel. All settlement offers/proposals and offers of judgment made or received in litigation must be provided to the Chief Counsel for reporting to the Board.

PUBLIC HEARING NOTICE: Development of the proposed rule is anticipated to be considered at the School Board's Special Meeting on Policies on May 31, 2006, anticipated to begin at 5:00 p.m. in the Board Chambers at 3300 Forest Hill Blvd., West Palm Beach, Fla. AGENDA: A copy of the agenda will be available by May 24 on the District's Web site. Pursuant to the provisions of the Americans with Disabilities Act, any person requiring special accommodations to participate in this hearing is asked to advise the agency at least 48 hours in advance by contacting the Board clerk at 434-8139. This hearing is open to the public.
