NOTICE OF PROPOSED RULE ADOPTION & PUBLIC HEARING

RULE TITLE: Land and Facility Interim Property Management.

RULE NUMBER: Policy 7.012.

PURPOSE AND EFFECT: To revise the Policy regarding use of "interim" property, defined as improved and/or unimproved real property of the School Board that is not currently being utilized for educational or ancillary purposes.

SUMMARY: The revision would clarify the role of the District’s chief of facilities management in evaluating "interim" property and the process for receiving letters of interest or proposals for leasing such Board-owned property. The process for Board approval of leasing "interim" property is also clarified. Pursuant to Fla. Stat. § 1002.33(18)(e), charter schools will have an equal opportunity to request a lease of "interim" property, as will other public schools and District departments or outside parties.

SPECIFIC RULEMAKING AUTHORITY: Fla. Stat. §§ 1001.41(2) & (3); 1001.42(2), (9), & (22); 1001.43(2) & (4).

LAWS IMPLEMENTED: Fla. Stat. §§ 1001.51(4), (10), & (11); 1013.15(1).

SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COST (optional, if one has been prepared): None prepared. Any person who wishes to provide information regarding a statement of estimated regulatory costs, or to provide a proposal for a lower cost regulatory alternative, must do so in writing within 21 days of the publication of this Notice.

PUBLIC HEARING NOTICE: Adoption of the proposed rule is anticipated to be considered at the School Board's Special Meeting on Policies on May 31, 2006, anticipated to begin at 5:00 p.m. in the Board Chambers at 3300 Forest Hill Blvd., West Palm Beach, Fla. AGENDA: A copy of the agenda will be available by May 24 on the District's Web site.
