NOTICE OF PROPOSED RULE ADOPTION
AND PUBLIC HEARING

RULE TITLE: Advisory Committees to the Board.

RULE NUMBER: Policy 1.09.

PURPOSE AND EFFECT: The provision of guidelines for advisory committees established by the School Board of Palm Beach County (Board) to advise the Board on specific issues pertaining to Palm Beach County public schools.

SUMMARY: The proposed revision include: elimination of Board members and District staff membership on advisory committees; the appointment, term and removal of committee members; procedures for committees meetings; establishment of meeting dates and time; annual organizational meetings; meeting agendas and minutes; quorum; meetings being subject to Sunshine Law; committee records beings subject to Public Records Law; committee members being subject to Ethics Laws; public participation; Superintendent designating staff for administrative support to committee; reports to Board; use of interactive video or telephone by committee members to attend meetings; and voting of committee members; the prohibition of an advisory committee from obligating the Board from the payment of any funds; provides for the Office of Chief Counsel to serve as legal advisor to a Board advisory committee; establishes that advisory committee decisions are recommendations which are not binding on the Board, and such recommendations must be submitted to the Board for consideration and actions.

Any person who wishes to provide information regarding a statement of estimated regulatory costs, or to provide a proposal for a lower cost regulatory alternative, must do so in writing within 21 days of the publication of this Notice.

PUBLIC HEARING NOTICE: Adoption of the proposed rule is anticipated to be considered at the School Board's Special Meeting on Policies on October 5, 2011, anticipated to begin at 5:00 p.m. (an approximate time, as the actual start time may vary earlier or later) in the Board Chambers at 3300 Forest Hill Blvd., West Palm Beach, Fla. AGENDA: An agenda will be available by September 28, 2011 on the District's Web site. Pursuant to the provisions of the Americans with Disabilities Act, any person requiring special accommodations to participate in this hearing is asked to advise the agency at least 48 hours in advance by contacting the Board clerk at 434-8139. A person may submit written comments (12 copies) about the proposed action to the clerk no later than the time of the public hearing. This hearing is open to the public.
