NOTICE OF RULE DEVELOPMENT
AND PUBLIC HEARING

RULE TITLE: Breach of Personal Identification Information.

RULE NUMBER: Policy 2.036.

SUBJECT AREA TO BE ADDRESSED: The security and confidentiality of personal data and information of students, parents/guardians, employees or retirees, job applicants, vendors and volunteers in an electronic format as well as other formats.

PURPOSE AND EFFECT: To provide for any potential risk of a breach in the District’s electronic system security and the possible disclosure of personal information regardless of its format, this policy addresses the manner in which the District will respond to an unauthorized access and acquisition of computerized data that compromises the security and confidentiality of unencrypted personal information.

SPECIFIC AUTHORITY: Fla. Stat. §§ 1001.41; 1001.42.

LAWS IMPLEMENTED: Fla. Stat. §§ 817.5681 Fair and Accurate Credit Transaction Act of 2003, Fair Credit Reporting Act (15 U.S.C. Sec. 1681 et seq.); Family Educational Rights and Privacy Act (20 U.S.C. sec. 1232g; 34 CFR Parts 99).

PUBLIC HEARING NOTICE: Development of the proposed rule is anticipated to be considered at the School Board's Special Meeting on Policies on February 3, 2010, anticipated to begin at 3:00 p.m. (an approximate time, as the actual start time may vary earlier or later) in the Board Chambers at 3300 Forest Hill Blvd., West Palm Beach, Fla. AGENDA: An agenda will be available by January 27, 2010 on the District's Web site. Pursuant to the provisions of the Americans with Disabilities Act, any person requiring special accommodations to participate in this hearing is asked to advise the agency at least 48 hours in advance by contacting the Board clerk at 434-8139. A person may submit written comments (12 copies) about the proposed action to the clerk no later than the time of the public hearing. This hearing is open to the public.
