NOTICE OF RULE DEVELOPMENT
AND PUBLIC HEARING

RULE TITLE: Equal Employment Opportunity Policy.

RULE NUMBER: Policy 3.05.

SUBJECT AREA TO BE ADDRESSED: The prohibition against discrimination on the basis of religion, race, ethnicity, national origin, color, sex, marital status, age, parental status, disability, sexual orientation or gender identity or expression or any other characteristic protected by federal and state law in all employment practices of the district.

PURPOSE AND EFFECT: To reaffirm the Board’s commitment to equal employment opportunities; assure the recruitment, employment, training, promotion and retention of qualified staff without discrimination; and to establish procedures for the reporting, the investigation, and the resolution of equal employment complaints in the School District.

SPECIFIC AUTHORITY: Fla. Stat. §§ 1001.41; 1001.42.

LAWS IMPLEMENTED: Fla. Stat. §§ 29 U.S.C. § 621, et. seq .(Age Discrimination in Employment Act of 1967, as amended).; 42 U.S.C. § 12101 et. seq. (Americans with Disabilities Act Amendments Act of 2008); Title VII, 42 U.S.C. § 2000e et. seq. (Title VII of the Civil Rights Act); 29 U.S.C. § 201 et. seq.(Fair Labor Standards Act); § 760.02, et. seq..

PUBLIC HEARING NOTICE: Development of the proposed rule is anticipated to be considered at the School Board's Special Meeting on Policies on April 28, 2010, anticipated to begin at 3:00 p.m. (an approximate time, as the actual start time may vary earlier or later) in the Board Chambers at 3300 Forest Hill Blvd., West Palm Beach, Fla. AGENDA: An agenda will be available by April 21, 2010 on the District's Web site. Pursuant to the provisions of the Americans with Disabilities Act, any person requiring special accommodations to participate in this hearing is asked to advise the agency at least 48 hours in advance by contacting the Board clerk at 434-8139. A person may submit written comments (12 copies) about the proposed action to the clerk no later than the time of the public hearing. This hearing is open to the public.
