NOTICE OF RULE DEVELOPMENT
AND PUBLIC HEARING

RULE TITLE: Probationary Appointments for Instructional Personnel.

RULE NUMBER: Policy 3.155.

SUBJECT AREA TO BE ADDRESSED: The identification of instructional personnel who are subject to the 97- day probationary period provision as described in §1012.33(3)(a)4, Fla. Stat. This also applies to annual contract instructional personnel as defined in §1012.01(2), Fla. Stat. who are newly hired and those who are considered rehired following a break in employment.

PURPOSE AND EFFECT: To describe procedures relating to termination during the probationary period. To clarify that if the provisions of a collective bargaining agreement conflict with this Policy, the provisions of the collective bargaining agreement will prevail.

SPECIFIC AUTHORITY: Fla. Stat. §§ 1001.32(2); 1001.41(1) & (2); 1001.42(5) & (23); 1001.43(1); 1012.33(3)(a)4; 1012.33(1)(b).

PUBLIC HEARING NOTICE: Development of the proposed rule is anticipated to be considered at the School Board's Special Meeting on Policies on July 30, 2008, anticipated to begin at 4:00 p.m. (an approximate time, as the actual start time may vary earlier or later) in the Board Chambers at 3300 Forest Hill Blvd., West Palm Beach, Fla. AGENDA: An agenda will be available by July 23, 2008 on the District's Web site. Pursuant to the provisions of the Americans with Disabilities Act, any person requiring special accommodations to participate in this hearing is asked to advise the agency at least 48 hours in advance by contacting the Board clerk at 434-8139. A person may submit written comments (12 copies) about the proposed action to the clerk no later than the time of the public hearing. This hearing is open to the public.
