NOTICE OF PROPOSED RULE ADOPTION
AND PUBLIC HEARING

RULE TITLE: ESE Policies and Procedures (SP&P).

RULE NUMBER: Policy 5.725.

PURPOSE AND EFFECT: This policy codifies the Board’s obligation to submit to Florida Department of Education, every three years, its “Exceptional Student Education Policies and Procedures (SP&P)”.

SUMMARY: The SP&P document has been amended by the Florida Department of Education (FDOE), as of January 28, 2011, to incorporate revisions to some of the State Board of Education Rules made during 2009-2010 and to reflect the creation of Fla. Stat. §1003.573 which was enacted by the 2010 Florida Legislature. Amendments to the SP&P were required regarding the following main areas: reporting, data collection, and monitoring of the use of seclusion and restraint;exceptional student education eligibility; development of IEP's; and participation in state and district assessments.

SPECIFIC AUTHORITY: Fla. Stat. §§ 1001.41(2); 1001.42(25).

LAWS IMPLEMENTED: Fla. Stat. §§ 1001.42(4)(l); 1003.57(1)(a)4; 1003.438; 1008.25.

SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COST (optional, if one has been prepared): None prepared. Any person who wishes to provide information regarding a statement of estimated regulatory costs, or to provide a proposal for a lower cost regulatory alternative, must do so in writing within 21 days of the publication of this Notice.

PUBLIC HEARING NOTICE: Adoption of the proposed rule is anticipated to be considered at the School Board's Special Meeting on Policies on July 27, 2011, anticipated to begin at 3:00 p.m. (an approximate time, as the actual start time may vary earlier or later) in the Board Chambers at 3300 Forest Hill Boulevard; West Palm Beach, Fla. AGENDA: An agenda will be available by July 20, 2011 on the District's Web site. Pursuant to the provisions of the Americans with Disabilities Act, any person requiring special accommodations to participate in this hearing is asked to advise the agency at least 48 hours in advance by contacting the Board clerk at 434-8139. A person may submit written comments (12 copies) about the proposed action to the clerk no later than the time of the public hearing. This hearing is open to the public.
