NOTICE OF RULE DEVELOPMENT
AND PUBLIC HEARING

RULE TITLE: Students Experiencing Homelessness.

RULE NUMBER: Policy 5.74.

SUBJECT AREA TO BE ADDRESSED: The proposed policy addresses the areas of: comparable student services; transportation; school selection, enrollment and enrollment disputes relating to students experiencing homelessness.

PURPOSE AND EFFECT: The purpose of this policy is to clarify statutory rights of children and youths experiencing homelessness as provided by federal and state law.

SPECIFIC AUTHORITY: Fla. Stat. §§ 1001.42, 1001.43, 1003.01(12); 1003.21.

LAWS IMPLEMENTED: Fla. Stat. §§ 1003.01(12); 1003.21 Title I, Part A of the Elementary and Secondary Education Act, 20 U.S.C. §§ 6311-6315; The McKinney-Vento Homeless Assistance Act, 42 U.S.C. §§ 11431-11436; Fla. Admin. Code § 65C-28(3).

PUBLIC HEARING NOTICE: Development of the proposed rule is anticipated to be considered at the School Board's Special Meeting on Policies on May 26, 2010, anticipated to begin at 2:00 p.m. (an approximate time, as the actual start time may vary earlier or later) in the Board Chambers at 3300 Forest Hill Blvd., West Palm Beach, Fla. AGENDA: An agenda will be available by May 19, 2010 on the District's Web site. Pursuant to the provisions of the Americans with Disabilities Act, any person requiring special accommodations to participate in this hearing is asked to advise the agency at least 48 hours in advance by contacting the Board clerk at 434-8139. A person may submit written comments (12 copies) about the proposed action to the clerk no later than the time of the public hearing. This hearing is open to the public.
