School Board of Palm Beach County

NOTICE OF PROPOSED RULE ADOPTION & PUBLIC HEARING

RULE TITLE: Number of Charter Schools.

RULE NUMBER: Policy 2.56.

PURPOSE AND EFFECT: To implement the exemption, approved by the State Board of Education on January 21, 2003, from the normal statutory limit on the number of charter schools that can be approved by the Board in this District.

SUMMARY: Implements an exemption under Charter District status by developing and adopting a Policy consistent with the State's waiver of the statutory cap on charter schools in this District. The exemption allows the Board to determine, on a case-by-case basis, the additional number of charter schools to be served above the normal limit of 28, and the School Board has the authority to determine if a charter school application meets the requirements of law to be a charter school and to determine if the addition of the charter school serves the needs of the student population in the District.

SPECIFIC RULEMAKING AUTHORITY: §§ 1001.41(2); 1003.62(2), Fla. Stat.

LAWS IMPLEMENTED: §§ 1003.62(2); exemption from 1002.33(13), Fla. Stat.

SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COST (OPTIONAL, IF ONE HAS BEEN PREPARED): None. Any person who wishes to provide information regarding a statement of estimated regulatory costs, or to provide a proposal for a lower cost regulatory alternative, must do so in writing within 21 days of the publication of this Notice.
