School Board of Palm Beach County

NOTICE OF PROPOSED RULE DEVELOPMENT AND HEARING

RULE TITLE: Number of Charter Schools.

RULE NUMBER: Policy 2.56.

SUBJECT AREA TO BE ADDRESSED: Implementing the exemption, approved by the State Board of Education on January 21, 2003, from the normal statutory limit on the number of charter schools that can be approved by the Board in this District.

PURPOSE AND EFFECT: To implement an exemption under Charter District status by developing and adopting a Policy consistent with the State's waiver of the statutory cap on charter schools in this District. The exemption allows the Board to determine, on a case-by-case basis, the additional number of charter schools to be served above the normal limit of 28, and the School Board has the authority to determine if a charter school application meets the requirements of law to be a charter school and to determine if the addition of the charter school serves the needs of the student population in the District.

SPECIFIC RULEMAKING AUTHORITY: §§ 1001.41(2); 1003.62(2), Fla. Stat.

LAWS IMPLEMENTED: §§ 1003.62(2); exemption from 1002.33(13), Fla. Stat.

CONTACT PERSON: Dr. Joseph Orr or Cheryl Alligood, 3300 Forest Hill Blvd., West Palm Beach, FL 33406.

THE PRELIMINARY TEXT of the Proposed Policy may promptly be obtained without cost from the District's web site at www.SchoolBoardPolicies.com/revisions.htm.

PUBLIC HEARING: It is anticipated that this Policy development will be considered at the School Board's Special Meeting on Policies on March 24, 2003, at 2:00 p.m. in the Board Chambers at 3300 Forest Hill Blvd., West Palm Beach, Fla. The meeting is open to the public.
