NOTICE OF PROPOSED RULE ADOPTION

RULE TITLE: Out-of-Field Teaching Assignments.

RULE NUMBER: Policy 3.16.

PURPOSE AND EFFECT: To implement a waiver approved by the State Board of Education on January 21, 2003, for Charter District status, granting an exemption from the timeline for School Board approval for teaching assignments of certified teachers in a field not listed on the certificate by the date normally required under Rule 6A-1.0503(3).

SUMMARY: Consistent with the State's waiver of the requirement of having School Board approval of out-of-field teacher assignments prior to the FTE survey weeks in October and February, under this Policy when the State FTE survey dates conflict with Board meeting dates, the list of out-of-field teacher assignments will be submitted for Board approval at the subsequent Board meeting date, ensuring that all out-of-field teacher assignments are approved by the Board, and out-of-field teacher assignments will be made only if there are no other qualified teachers certified in that field available from the applicant or faculty pool.

LAWS IMPLEMENTED: §§ 1001.41(1), (3); 1001.42(5); 1003.62(2), Fla. Stat., and exemption from the timeline under State Board of Education Rule 6A-1.0503(3).

Any person who wishes to provide information regarding a statement of estimated regulatory costs, or to provide a proposal for a lower cost regulatory alternative, must do so in writing within 21 days of the publication of this Notice.

HEARING: As approved by the School Board on February 17, 2003, pursuant to Fla. Stat. § 120.54(3), no further public hearing will be held on this proposed rule unless the Clerk of the School Board receives a written request, with copy to the Office of Chief Counsel, from an affected person within 21 days of the Feb. 24th publication date of this notice. Thus, the proposed Policy should be adopted and effective on March 24, 2003 (28 days after publication of this notice).
