NOTICE OF PROPOSED RULE ADOPTION & PUBLIC HEARING

RULE TITLE: Definition of "Retiree" for Purposes of the Health Plan.

RULE NUMBER: Policy 3.79.

PURPOSE AND EFFECT: Codifies the District's definition of which persons retired from District employment under the FRS Investment Plan will be classified as retirees for purposes of continuation in the District’s health insurance plan.

SUMMARY: Clarifies, for purposes of having the option of continuing in the District’s health insurance plan under Fla. Stat. § 112.0801, the criteria for being deemed a "retiree" under the FRS Pension Plan and the FRS Investment Plan (Public Employee Optional Retirement Program).

Any person who wishes to provide information regarding a statement of estimated regulatory costs, or to provide a proposal for a lower cost regulatory alternative, must do so in writing within 21 days of the publication of this Notice.

PUBLIC HEARING NOTICE: Adoption of the proposed rule is anticipated to be considered at the School Board's Special Meeting on Policies on September 13, 2004, anticipated to begin at 2:15 p.m. in the Board Chambers at 3300 Forest Hill Blvd., West Palm Beach, Fla. AGENDA: A copy of the agenda will be available by September 6 on the District’s Web site.
