NOTICE OF PROPOSED RULE ADOPTION & PUBLIC HEARING

RULE TITLE: Drug and Alcohol-Free Workplace Policy for Employees Performing Safety-Sensitive Functions and Holders of Commercial Drivers Licenses.

RULE NUMBER: Policy 3.961.

PURPOSE AND EFFECT: To set forth drug-free workplace standards and testing procedures for employees working in safety-sensitive functions.

SUMMARY: Codifies a drug- and alcohol-free workplace program, similar to current practice under state and federal standards, for employees working in safety-sensitive functions.

SPECIFIC RULEMAKING AUTHORITY: §§ 1001.41(1), (2); 1001.43(11), Fla. Stat.

LAWS IMPLEMENTED: §§ 440.102, Fla. Stat; Omnibus Transportation Employee Testing Act of 1991, Pub. L. 102-143; 49 U.S.C. Chapter 53; Regulations of Federal Motor Carrier Safety Administration; Title 49 Code of Federal Regulations, Parts 40 and 382.

SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COST (OPTIONAL, IF ONE HAS BEEN PREPARED): None. Any person who wishes to provide information regarding a statement of estimated regulatory costs, or to provide a proposal for a lower cost regulatory alternative, must do so in writing within 21 days of the publication of this Notice.
