NOTICE OF PROPOSED RULE ADOPTION & PUBLIC HEARING

RULE TITLE: Student Records Correction and Appeals.

RULE NUMBER: Policy 5.1816.

PURPOSE AND EFFECT: To provide procedures for correction of information contained within student education records, upon request by a parent or adult student.

SUMMARY: Provides uniform guidelines and procedures for the correction, deletion, expunction, or rebuttal of education record data that a parent or adult student shows to be inaccurate, misleading, or otherwise inappropriate under Fla. Stat. § 1002.22(3)(c).

SPECIFIC RULEMAKING AUTHORITY: §§ 1001.41(2); 1001.43(6), (8), Fla. Stat.

LAWS IMPLEMENTED: §§ 1002.22(3)(c); 20 U.S.C. § 1232g(a)(2), (b)(1)(B), Fla. Stat.

STATE BOARD OF EDUCATION RULE SUPPLEMENTED: 6A-1.0955(6)(k).

SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COST (OPTIONAL, IF ONE HAS BEEN PREPARED): None. Any person who wishes to provide information regarding a statement of estimated regulatory costs, or to provide a proposal for a lower cost regulatory alternative, must do so in writing within 21 days of the publication of this Notice.
