NOTICE OF PROPOSED RULE ADOPTION & PUBLIC HEARING

RULE TITLE: Student Expulsion.

RULE NUMBER: Policy 5.1817.

PURPOSE AND EFFECT: To codify procedures and standards for making and processing recommendations for the expulsion of students for serious violations of the Student Code of Conduct.

SUMMARY: Codifies uniform procedures and standards for administrators in making and processing recommendations for student expulsion; procedures for hearing officers; and standards for Board consideration of expulsion recommendations.

SPECIFIC RULEMAKING AUTHORITY: §§ 1001.41(2); 1001.43(1), 1006.07, 1006.09(1)(c)2, Fla. Stat.

LAWS IMPLEMENTED: §§ 1001.43(1)(e), 1002.20; 1006.07; 1006.08; 1006.09(1)(c)2; 1006.13, Fla. Stat.

SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COST (OPTIONAL, IF ONE HAS BEEN PREPARED): None. Any person who wishes to provide information regarding a statement of estimated regulatory costs, or to provide a proposal for a lower cost regulatory alternative, must do so in writing within 21 days of the publication of this Notice.

PUBLIC HEARING NOTICE: Adoption of the proposed rule is anticipated to be considered at the School Board's Special Meeting on Policies on June 28, 2004, anticipated to begin at 2:15 p.m. in the Board Chambers at 3300 Forest Hill Blvd., West Palm Beach, Fla. (Additionally, a public workshop for Board discussion of this and other proposed Policies will be held on June 21 at 4:00 p.m.)   AGENDA: A copy of the agenda will be available by June 21 on the District’s Web site. Pursuant to the provisions of the Americans with Disabilities Act, any person requiring special accommodations to participate in these meetings is asked to advise the agency at least 48 hours before the workshop by contacting the Board clerk at 434-8139. These meetings are open to the public.
