NOTICE OF PROPOSED RULE ADOPTION

RULE TITLE: Students with Chronic Illnesses and Infectious Diseases (Including HIV/AIDS).

RULE NUMBER: Policy 5.322.

PURPOSE AND EFFECT: To update the rule to clarify the confidentiality requirements regarding students with HIV/AIDS, by request of the Department of Education, Educational Equity Opportunity Program.

SUMMARY: This revision will make it more clear that the confidentiality provisions for HIV/AIDS status, which are already stated in Section (4) of the Policy, are equally applicable to Section (3)(b)(i), regarding school personnel’s duty to report when a student’s health condition is believed to present a significant risk of transmitting a communicable disease; also updates statutory references.
