NOTICE OF PROPOSED RULE DEVELOPMENT

RULE TITLE: Students with Chronic Illnesses and Infectious Diseases (Including HIV/AIDS).

RULE NUMBER: Policy 5.322.

SUBJECT AREA TO BE ADDRESSED: Minor update to clarify the confidentiality requirements regarding students with HIV/AIDS.

PURPOSE AND EFFECT: This update was requested by the Department of Education, Educational Equity Opportunity Program, in order to make it more clear that the confidentiality provisions for HIV/AIDS status, which are already stated in Section (4) of the Policy, are equally applicable to Section (3)(b)(i), regarding school personnel's duty to report when a student’s health condition is believed to present a significant risk of transmitting a communicable disease.
