NOTICE OF PROPOSED RULE ADOPTION & PUBLIC HEARING

RULE TITLE: Student Records.

RULE NUMBER: Policy 5.50.

PURPOSE AND EFFECT: To clarify standards for parental access to student records and reports; maintaining confidentiality of personally-identifiable student information; and designation of other school officials with legitimate educational interests in accessing student records.

SUMMARY: This revision expands the Policy to incorporate some content from Directive 5.05 and the annual notice of FERPA rights; codifies the identity of "other school officials" (such as certain of the District's agents, contractors, and partners) who may access student records without parental consent, for a legitimate educational purpose; and clarifies procedures such as handling subpoenas for student records and how parents may opt out from access to secondary students' directory information by military recruiters or institutions of higher learning.

Any person who wishes to provide information regarding a statement of estimated regulatory costs, or to provide a proposal for a lower cost regulatory alternative, must do so in writing within 21 days of the publication of this Notice.

PUBLIC HEARING NOTICE: Adoption of the proposed rule is anticipated to be considered at the School Board's Special Meeting on Policies on August 2, 2004, anticipated to begin at 2:15 p.m. in the Board Chambers at 3300 Forest Hill Blvd., West Palm Beach, Fla. AGENDA: A copy of the agenda will be available by July 26 on the District’s Web site.
