NOTICE OF PROPOSED RULE ADOPTION & PUBLIC HEARING

RULE TITLE: Errors and Omissions of Construction-Related Professionals.

RULE NUMBER: Policy 7.065.

PURPOSE AND EFFECT: To provide for handling errors or omissions by construction-related professionals, such as architects and engineers, under contract with the Board.

SUMMARY: Sets forth the guidelines for handling errors or omissions by construction-related professionals, under contract with the Board, which lead to contingency change authorizations, authorizations to adjust contingency, construction change directives, and change order request proposals in the District’s construction projects. To document that the necessary review of changes has occurred, the professional must include a statement on all changes submitted, stating that the changes have been examined and found to be necessary, and stating whether the changes represent any additional cost to the School District other than value added.

Any person who wishes to provide information regarding a statement of estimated regulatory costs, or to provide a proposal for a lower cost regulatory alternative, must do so in writing within 21 days of the publication of this Notice.

PUBLIC HEARING NOTICE: Adoption of the proposed rule is anticipated to be considered at the School Board's Special Meeting on Policies on September 13, 2004, anticipated to begin at 2:15 p.m. in the Board Chambers at 3300 Forest Hill Blvd., West Palm Beach, Fla. AGENDA: A copy of the agenda will be available by September 6 on the District’s Web site. Pursuant to the provisions of the Americans with Disabilities Act, any person requiring special accommodations to participate in these meetings is asked to advise the agency at least 48 hours before the workshop by contacting the Board clerk at 434-8139.
