NOTICE OF PROPOSED RULE ADOPTION
RULE TITLE: Granting Drainage Easements. RULE NUMBER: Policy 7.172. PURPOSE AND EFFECT: To set forth procedures and standards for granting drainage easements to private developers or landowners. SUMMARY: This proposed Policy will establish standardized procedures for evaluating requests from developers or landowners for an easement across school property to enable drainage of their land into canals closer to the school property. Sets forth procedures for valuing the easement via an appraisal; requires payment of the consideration; mandates certain provisions in the easement agreement; and requires the easement to be recorded as a written instrument.
