NOTICE OF PROPOSED RULE DEVELOPMENT & PUBLIC HEARING

RULE TITLE: Granting Easements and Licenses.

RULE NUMBER: Policy 7.172.

SUBJECT AREA TO BE ADDRESSED: Standards and procedures for granting easements and licenses on School Board property.

PURPOSE AND EFFECT: To revise the Policy (which currently relates only to procedures and standards for granting drainage easements) to include general easements and licenses. The revision standardizes procedures for evaluating requests for an easement or license on School Board property; establishes procedures for valuation via an appraisal; requires payment of consideration; mandates certain provisions in the agreement; and requires easements to be recorded as a written instrument.

PUBLIC HEARING NOTICE: Development of the proposed rule is anticipated to be considered at the School Board's Special Meeting on Policies on June 28, 2004, anticipated to begin at 2:15 p.m. in the Board Chambers at 3300 Forest Hill Blvd., West Palm Beach, Fla. AGENDA: A copy of the hearing agenda will be available by June 21 on the District’s Web site. Pursuant to the provisions of the Americans with Disabilities Act, any person requiring special accommodations to participate in this hearing is asked to advise the agency at least 48 hours before the workshop by contacting the Board clerk at 434-8139. This meeting is open to the public.
