NOTICE OF PROPOSED RULE ADOPTION & PUBLIC HEARING

RULE TITLE: Instructional Materials Accountability.

RULE NUMBER: Policy 8.1225.

PURPOSE AND EFFECT: To allow recovery of the new-purchase value of instructional materials, such as textbooks, that are lost, destroyed, or unnecessarily damaged during the first two years of use.

SUMMARY: Implements an exemption recognized by the State Board of Education on February 17, 2004, under Charter District status. Although Fla. Stat. § 1006.28(3)(b) would normally permit recovery of 100% of a textbook's new-purchase-price value if it was lost, destroyed, or unnecessarily damaged during the first one year of use, this exemption allows 100% of the new-purchase price to be recovered during the first two years of use.

Any person who wishes to provide information regarding a statement of estimated regulatory costs, or to provide a proposal for a lower cost regulatory alternative, must do so in writing within 21 days of the publication of this Notice.

PUBLIC HEARING NOTICE: Adoption of the proposed rule is anticipated to be considered at the School Board's Special Meeting on Policies on August 2, 2004, anticipated to begin at 2:15 p.m. in the Board Chambers at 3300 Forest Hill Blvd., West Palm Beach, Fla. AGENDA: A copy of the agenda will be available by July 26 on the District’s Web site.
