Title: CS1 Third Amendment to the Charter for Western Academy

Recommendation:
I recommend that the School Board approve the Third Amendment to the Charter for Western Academy Charter School effective March 16, 2005.

Description:

The School Board approved the Charter for Western Academy Charter School and the parties entered into the Charter Agreement at the April 23, 2003, School Board Meeting.

The term for the Charter for Western Academy Charter School  is July 1, 2003 through June 30, 2008.

On or about August 20, 2004, the School Board received written correspondence from the Charter School, a copy of which is attached to this Amendment, requesting that the following two changes be made to their Charter:

Item 1. Section 4.0-C -- All references to "the Personal Education Plans (PEP)" in the Charter shall be removed and replaced with "the CHILD (Changing How Instruction for Learning is Delivered) model of instruction."

Item 2: Section 28.0-A - The Charter School's responsibility for fingerprinting processing fees shall be removed from this section of the Charter Agreement and  replaced with, "the potential employee agrees that he/she will be responsible for the  fingerprinting processing fees."

Therefore, the language in the Charter Agreement shall be amended as requested above.

All other provisions of the approved Charter shall remain the same.

In the event of any conflict between the Third Amendment and Charter Agreement, the terms of the Third Amendment shall control.
