Title: Delegation of Authority for Concurrency Consulting Agreements

Recommendation:

  • Palm Beach County is the first School District in the state to implement a School Concurrency program successfully.
  • Senate Bill 360, passed in 2005, now mandates that all 67 counties in the state of Florida must implement a School Concurrency program by 2008.
  • Given Palm Beach County's 5-year history of successful concurrency implementation, School District Planning staff's expertise has been requested by a number of other School Districts and counties.
  • Given that only two Planning Department professionals are thoroughly experienced and conversant in School Concurrency, these are demands being placed on a very limited staff resource.
  • A legal opinion dated November 21, 2005, indicated that the School District of Palm Beach County may enter into Interlocal Agreements that provide reimbursement of staffing costs associated with consulting services provided to other districts. (Please see attached)
  • To date, staff has been contacted by Collier County, Lake County, Miami-Dade County and the Department of Community Affairs.

Description: I recommend the School Board delegate authority to the Superintendent, or designee, to negotiate Interlocal Agreements with other School Districts or County Government Agencies in order to provide School Concurrency Consulting Services.

Financial Impact:
Depending on the number of counties expressing an interest, expected revenue is $150 per hour of staff time and reimbursement of any travel costs.
