Title: P7 RFP 03C-022H for Legal Services

Recommendation:

I recommend approval of the renewal of RFP 03C-022H for Legal Services for the Department of Employee Benefits and Risk Management and authorize the Superintendent and Board Chairman to sign all necessary documents.

Description:

P7  Approve the renewal of RFP 03C-022H for Legal Services for the Department of Employee Benefits and Risk Management

·      Request for Proposal No.03C-022H was awarded by Board action on September 17, 2003, to Adorno & Yoss, P.A., Paxton & Smith, P.A., Michael A Bryant, P.A., Conroy, Simberg, Ganon, Krevans & Abel, Haliczer Pettis Law Offices, Miller, Kagan, Rodriguez & Silver, P.A., Panza, Maurer & Maynard, P.A., Silver Levy & Feldman, P.A., Walton, Lantaff, Schroeder & Carson, LLP for  three year(s) from September 18, 2003 through September 17, 2006 with the option to renew for one addi­tional two-year periods.

·      The first and final option is now being exercised for the period September 18, 2006 through September 17, 2008.

 ·       Michael A Bryant, P.A., Conroy, Simberg, Ganon, Krevans & Abel, Haliczer Pettis Law Offices, Lorna Brown, Burton P.A., Panza, Maurer & Maynard, P.A., Silver Levy & Feldman, P.A., and Walton, Lantaff, Schroeder and Carson LLP have agreed to honor terms, conditions and pricing of existing con­tract for the forth­coming contract period.  The cases previously awarded to Miller, Kagen, Rodriguez, Silver, P.A., have been reassigned to The Law Offices of Lorna Brown-Burton, P.A., per Board action March 10, 2004. 

·   Adorno & Yoss, P.A. and Paxton & Smith, P.A. have chosen not to renew.  

·      Services to be provided include legal services for the Department of Risk Management for their third party Liability Claims and Workers Compensation Claims.

Financial Impact:
The financial impact to the District Budget is estimated at $3,500,000 per year or a total of $7,000,000 for the two-year period.  The source of funds is the Department of Employee Benefits and Risk Management.  This includes worker’s compensation claims, personal injury, auto and general liability claims.
