Title: IN2 Auto Liability /Jeffrey Schwarz 703457

Recommendation:
I recommend that the School Board approve the Auto Liability claim #703457 in the amount of $75,000 to Jeffrey Schwatrz, representing compensation, attorneys' fees and costs and authorize the execution of all related documents.  This settlement will finalize all outstanding issues.

Description:

The Settlement of this claim was recommended by the District's outside counsel and claim adjusters and has been approved by the Chief Counsel, Chief Financial Officer and Director of Employee Benefits and Risk Management as required by District Policy #6.09.

A 41 year old pitching coach, sustained multiple and serious injuries after being struck by our school bus on 11/11/04.  He sustained injury to his neck, left shoulder, right forearm, left hip and both knees which did not allow him to return to his job with the Florida Marlins. His medical bills are in excess of $20,000 at this time and a knee surgery has been suggested.

This is a negotiated settlement of $75,000 against a demand of $100,000.

 The settlement will extinguish all future liabilities including ongoing litigation costs for this individuals claim.

Financial Impact:
The financial  impact to the District for this settlement is $75,000.  The source of funds is the General Fund.
