Title: IN1 General Liability /Nicole Harmon 544732

Recommendation:
I recommend that the School Board approve the General Liability claim #NH544732  of Nicole Harmon and her parent and natural guardian, Kimberly Harmon, in the amount of $53,300 representing compensation, attorneys' fees and costs and authorize the execution of all related documents.  This settlement will finalize all outstanding issues.

Description:

The Settlement of this claim was recommended by the District's outside counsel and claim adjusters and has been approved by the Chief Counsel, Chief Financial Officer and Director of Employee Benefits and Risk Management as required by District Policy #6.09.

A student, now 15, was  allegedly beaten and punched during class.  Injuries include shoulder and neck injuries along with a claim of post traumatic stress and nightmares.  The lack of supervision was the reason for liability.  Medicals are in excess of $6,000 not including a claim for reimbursement for private school tuition exceeding $30,000.

This is a negotiated settlement of $53,300 against a demand of $100,000.

 The settlement will extinguish all future liabilities.

Financial Impact:
The financial  impact to the District for this settlement is $53,300.  The source of funds is the General Fund.
