Title: IN4 General Liability / HJ and FJ as parents and guardians of TJ 134595

Recommendation:
I recommend that the School Board approve General Liability claim #134595 for H.J. and F.J. as parents and guardians of T.J. in the amount of $60,000 representing compensation, attorneys' fees and costs and authorize the execution of all related documents.  This settlement will finalize all outstanding issues.

Description:

The Settlement of this claim was recommended by the District's outside counsel and claim adjusters and has been approved by the Chief Counsel, Chief Financial Officer and Director of Employee Benefits and Risk Management as required by District Policy #6.09.

A student, now 24 years old, was  allegedly inappropriately touched by another student during a class field trip.

This is a negotiated settlement of $60,000 against a demand of $100,000.

 The settlement will extinguish all future liabilities including ongoing litigation costs.

Financial Impact:
The financial  impact to the District for this settlement is $60,000.  The source of funds is the General Fund.
