Title: PD3 Settlment & Release Re: Earl Webster

Recommendation:

I recommend that the School Board approve the Settlement & Release in the matter of Earl Webster  v. Palm Beach County School District, a copy of which is attached hereto, and authorize the execution of all related documents.

Description:

• Mr. Webster was a custodian at Dwyer High School who was involuntarily resigned on October 20, 2004.
•  
• Mr. Webster filed to an EEOC complaint citing a hostile working environment based upon disparate treatment of “foreign” employees.    
• This claim was settled in conjunction with Mr. Webster’s Worker’s Compensation claim which has been settled through F. A. Richard, the Third Party Liability Carrier. 
• Authority in the amount of $15,000.00, to settle all claims, was granted by the Board at a prior Attorney Client Session.
• Settling this judgment in the amount of $15,000.00 is in the best interest of the District

Financial Impact:
The financial impact to the District is $15,000.00 from the general fund.
