Title: PD4 Final Order Re: Marion Jones

Recommendation:
I recommend that the School Board approve the Final Order for School Board of Palm Beach County v. Marion Jones, a copy of which is attached hereto, and authorize the execution of all related documents.

Description:

• On July 7, 2004 the Superintendent signed an administrative petition for termination of employment of Ms Jones.
• On June 6 and 7, 2005, an Administrative Hearing was held before Judge Florence Rivas regarding the termination of employment of Ms. Jones.
• On that day, the parties agreed that the only issue for Judge Rivas to rule on was whether or not the District could accommodate Mr. Jones’ permanent work restrictions.  From the bench, the Judge ruled as a matter of fact that the District could not accommodate Ms. Jones’ permanent restrictions. An excerpt of the transcript is attached for clarity.
• This Final Order is in the best interest of the School Board.
