• On January 25, 2006 the School Board approved the Ground Lease and Cooperative Agreement for 03-Y. (See Exhibit “A”)

• Following the School Board’s approval of the agreements the following changes occurred:

         The funding of the construction of 03-Y

          must be out of non-COPS Capital

          revenue sources.

          The surface water will remain on-site

           instead of a two acre area off-site that

           reduces FAU’s credit toward construction

           and reduces the School District’s

           contribution from $2,765,000.00 to

           $2,475,000.00.

           The School Board and FAU will work

           exclusively together to create a

           curriculum that incorporates the Florida

           Department of Education K-5 SSS

           and the Palm Beach County School

           District goals and key results through

           environmental themes that focus on

           content and technology for the

           achievement of all students.

• All documents must be fully executed by the School Board prior to August 1, 2006 or FAU is obligated to return the deed and conservation easement to the FAU Foundation.
