Title: IN2 General Liability /Maureen Irving as parent of Carl Malcolm 703696

Recommendation:
I recommend that the School Board approve the Worker's Compensation claim #CM 703696 in the amount of $63,000 representing compensation, attorneys' fees and costs and authorize the execution of all related documents.  This settlement will finalize all outstanding issues.

Description:

The Settlement of this claim was recommended by the District's outside counsel and claim adjusters and has been approved by the Chief Counsel, Chief Financial Officer and Director of Employee Benefits and Risk Management as required by District Policy #6.09.

A now 18 year old student sustained neck and alleged brain injuries after a fight in the parking lot of his high school in 2004;  the allegations include negligent supervision, training and retention.  His  injuries resulted in a serious head injury and over $40,000 in medical bills.  We will include any liens in the settlement.  This is a negotiated settlement against a demand of $100,000.

 The settlement will extinguish all future liabilities.

Financial Impact:
The financial  impact to the District for this settlement is $63,000.  The source of funds is the General Fund.
