Title: IN6 Auto Liability /Claudia Kautz as personal representative of the estate of Diana Kautz 701259 Recommendation:
I recommend that the School Board approve the Auto Liability claim #701259 in the amount of $200,000 as well as agree not to oppose a claims bill in the amount of an additional $900,000, representing compensation, attorneys' fees and costs and authorize the execution of all related documents.
Description: The Settlement of this claim was recommended by the District's outside counsel and claim adjusters and has been approved by the Chief Counsel, Chief Financial Officer and Director of Employee Benefits and Risk Management as required by District Policy #6.09.
A 15 year old student, sustained fatal injuries after our school bus allegedly failed to yield at a stop sign and struck a truck on 11/11/04. The settlement will resolve any liens.
This is a negotiated settlement of $200,000 of statutory limits payable upon receipt of a release and an agreement not to oppose a claims bill of up to $900,000 which the plaintiff may file annually until approved, for a period not to exceed 5 years. A jury exposure was estimated at between $2-3 million.
The settlement will limit all future liabilities to the terms above.
Financial Impact:
The initial financial impact to the District for this settlement is $200,000. The source of funds is the General Fund
