Title: IN1 Auto Liability Julie Smith, Pers. Rep of Estate of Larry A. Shields/ 623666

Recommendation:
I recommend that the School Board approve the Auto Liability claim #623666 in the amount of $75,000 representing compensation, liens, attorneys' fees and costs and authorize the execution of all related documents.  This settlement will finalize all outstanding issues.

Description:

The Settlement of this claim was recommended by the District's outside counsel and claim adjusters and has been approved by the Chief Counsel, Chief Financial Officer and Director of Employee Benefits and Risk Management as required by District Policy #6.09.

A 48 year old pedestrian, sustained fatal  injuries after being struck by our school bus on 10/16/03.  He was struck by our driver who was making a left turn. Liability is comparative among both parties. His medical bills are in excess of $150,000 incurred in ICU.

This is a negotiated settlement of $75,000 against a demand of $100,000.

 The settlement will extinguish all future liabilities including ongoing litigation costs for this individuals claim.

Financial Impact:
The financial  impact to the District for this settlement is $75,000.  The source of funds is the General Fund.
