New Business - Charter Schools

Title: CS2 Third Amendment to the Charter for Palm Beach Military Academy

Recommendation:

I recommend that the School Board approve the Third Amendment to the Agreement with Palm Beach Military Academy Charter School.

Description:

The School Board of Palm Beach County, Florida, ("School Board") and the Palm Beach Military Charter School, ("Charter School"), entered into an Agreement on April 21, 2005.

 

On January 18, 2006, the School Board approved the Second Amendment from the Charter School to defer its opening date until August 1, 2006.

 

On July 12, 2006 the School Board received written correspondence from the Charter School requesting that its opening date be deferred until September 5, 2006.

 

The request was based upon the fact that a facility would not be available until September 5, 2006.

 

The School Board met with the Charter School on July 13, 2006, and the parties agreed to not extend the opening to September 5, 2006 but all documents and time frames outlined in the Charter Agreement and Second Amendment would be submitted and completed on or before July 31, 2006.

 

In the event that the school does not provide all of the documentation on or before July 31, 2006, the Charter Agreement would be “immediately terminated” effective August 16, 2006.

 

In the event of any conflict between the terms of the Third Amendment and the Charter Agreement, the terms of the Third Amendment shall control.

 

The Superintendent is authorized to take administrative action on delayed or deferred openings of Charter Schools.

 

Financial Impact:

There is no financial impact to the District.
