New Business - Charter Schools

Title: CS4 Second Amendment to the Charter for New Vision Child Academy

Recommendation:

I recommend that the School Board approve the Second Amendment to the Agreement with New Vision Child Academy, Inc.

Description:

The School Board of Palm Beach County, Florida, ("School Board") and New Vision Child Academy, Inc., ("Charter School"), entered into an Agreement on April 21, 2005.

 

On August 17, 2005, the School Board approved the First Amendment from the Charter School to defer its opening date until August 1, 2006.

 

On May 1, 2006 the School Board received written correspondence from the Charter School requesting that its opening date be deferred until August 1, 2007.

 

The request was based upon the fact that a facility would not be available until August 1, 2007.

 

In the event the Charter School does not obtain a facility on or before June 15, 2007, the Charter Agreement would be "immediately terminated" effective June 15, 2007, and the Charter School will not appeal this termination.

 

In the event of any conflict between the terms of the Second Amendment and the Charter Agreement, the terms of the Second Amendment shall control.

 

The Superintendent is authorized to take administrative action on delayed or deferred openings of Charter Schools.

Financial Impact:

There is no financial impact to the District.
