Title: IN2 General Liability /Juan DeJesus as parent of Eudys DeJesus 652712

Recommendation:
I recommend that the School Board approve the General Liability claim #651712 in the amount of $75,000 representing compensation, attorneys' fees and costs and authorize the execution of all related documents.  This settlement will finalize all outstanding issues.

Description:

The Settlement of this claim was recommended by the District's outside counsel and claim adjusters and has been approved by the Chief Counsel, Chief Financial Officer and Director of Employee Benefits and Risk Management as required by District Policy #6.09.

A student, now 13 years old, was  allegedly unsupervised when he was hurt during a football game before school.  He sustained a fracture of the left femur which required surgery and 4 pins as well as in excess of $68,000 in medical bills.

This is a negotiated settlement of $75,000 against a demand of $100,000.

 The settlement will extinguish all future liabilities including ongoing litigation costs.

Financial Impact:
The financial  impact to the District for this settlement is $75,000.  The source of funds is the General Fund.
