Title: RE-5 New Suncoast High School

Recommendation:
I recommend the School Board approve a Resolution authorizing the acquisition of certain real property consisting of 13.805 acres more or less, through eminent domain proceedings, for the New Suncoast High School authorizing the Legal Department to hire an eminent domain attorney; approve a resolution declaring structure(s) located on the property to be acquired by the School Board to be unnecessary for educational purposes, surplus and without commercial value; and authorizing the Chairman and Superintendent to sign all necessary documents.

Description:

• The FY 2006-2010 Five Year Plan includes the construction of a New Suncoast High School, scheduled for opening in August 2009.

• The 13.805 acres, more or less is located south of Blue Heron Boulevard, west of Avenue “S”, east of Congress Avenue and north of 13^th Street. (See Parcel Maps Exhibit “A”).

• Program Management, Planning and Boundaries have reviewed the subject property and support the site plan.

• The owners are unwilling sellers.

• Acquisition of this land is needed to successfully complete the School Facility and meet the construction deadline.

• A Phase I Environmental Audit has been completed on all the properties.  A Phase II Environmental Audit has been completed where required.  The Phase II revealed the need for the removal and disposal of a limited amount of solid waste material.  The cost of removal will be taken into consideration as part of the eminent domain negotiations.

• In order to facilitate the timely acquisition of the properties it is necessary to use the eminent domain process.

• This process provides a “quick taking” of the property, but does not limit negotiations with the owners to arrive at a contractual settlement including distribution of funds either before or after the Order of Taking.

Financial Impact:

The financial impact to the Project’s Budget is not to exceed $8,500,000.00.
