Title: Consider the Termination of the Agreement with CEP and Acceptance of the Settlement Proposal Submitt Recommendation:
I recommend that the School Board terminate the Agreement with CEP and accept the Settlement Proposal submitted by CEP. I further recommend that the School Board give authority to the Superintendent and the Chief Counsel to take any and all necessary actions in order for the District to take control of and/or close the CEP program at Oak Grove Academy.
Description: The School Board approved a six (6) year contract with CEP on June 29, 2005. The Superintendent would like to takeover/terminate the program operated by CEP at Oak Grove Academy and CEP has submitted a Settlement Proposal regarding the early termination of the Agreement with CEP.
Financial Impact:
The financial impact to the District's FY2007 budget under the proposed settlement is $3.6 million. This amount reflects the reduction in the District’s contractual obligation to CEP for FY2007. The settlement includes payment to CEP for the months of November and December at a combined cost of $484,711. The financial impact of the alternative recommendation to immediately terminate the contract is $4.1 million. Of the original contract obligation, approximately $700,000 was to be funded through the Special Revenue Private/Public Alternative Education Partnership grant. The remaining cost of the contract impacts the General Fund Operating Budget. Funds released by the cancellation of this contract will be redirected as needed to meet the needs of the students.
