Title: CC1 Amendment for the Law Firm of Fish & Richardson

Recommendation:
I recommend award of the Amendment with Fish & Richardson for $100,000.00, through June 30, 2007, and authorize the Superintendent and Board Chairman to sign all needed documents.

Description:

CC 1 The Consultant shall perform the following services: Legal Advisor shall provide FCC regulatory and transactional advice to the School District with respect to Educational Broadband Service Spectrum including any negotiations with Sprint. 

This amendment is to increase the maximum payment amount an additional $100,000 through the term of the contract, June 30, 2007.

Staff and Chief Counsel need an attorney with expertise in FCC regulatory matters, spectrum use and valuation issues to assist staff in the evaluation of the alternatives available to the School Board.

The firm of Fish & Richardson and Attorney Ed Lavergne have provided excellent service since being hired in March 2005.  Approval of the funds requested in this amendment will allow Mr. Lavergne to provide staff with a sound basis for making decisions as to the future use of the School Board's spectrum.

Authorized Amount this Request: $100,000.00

Previously Authorized Amount Year-to-Date: $75,000.00

Total Authorized Amount if Request Approval: $175,000.00
