Title: PM7 Santaluces High Project Modification and Final

Recommendation:

I recommend the School Board ratify the closeout finances,  approve the use of sales tax savings in the amount of $22,418.16 in Construction Change Directive #3 to pay authorized project expenses for the Santaluces Community High School, Auditorium Project #1611-8272, and authorize the Chairman and Superintendent to execute all related contract documents.

Description:

This project modification contains the following item:

 

Item #1

  • CCD #3 in the amount of $22,418.16
  • Description:  The final project amount was approved by the Board at its August 9, 2006 meeting.  However, it has become clear since then that the amount needs to be adjusted, also, it was not made clear to the Board at that time that project expenses were to be covered by sales tax savings.
  • Cause:  School District Requested
  • Justification: 
    • Adjustments have been made on the sales tax report, due to a nuance in tax law for the Use Tax.  Two vendors, Heavy Iron Welding at 5.2% and Steel Fabricators at 4.7%, are permitted by law to pay less sales tax.  Hence, the savings to the District are reduced.
    • The Contractor achieved the guaranteed sales tax savings of $40,000 and exceeded it by another $22,418.16.  Total savings realized is $62,418.16.
    • The extra savings is needed to pay the approved project cost.   The adjusted GMP is therefore, $ 4,284,818.38.  We have paid the contractor, to date $ 4,247,712.71; therefore, final payment to The Weitz Company is $37,105.67.

Item #2

 

Description: The Project Architect, MPA Architects, has certified that Santaluces Community High School, under contract with The Weitz Company, achieved Final Completion. 

 

The General Contractor has requested, and the Architect and Staff have recommended, Final Payment and Final Acceptance.

 

  • Punch List items were Completed 
  • Certification of Occupancy was Obtained
  • Closeout Documents were Received
  • Errors & Omissions did not Exceed 1%
  • Final M/WBE Participation Achieved over 20%

Financial Impact:

The Financial Impact to the Project’s Budget is $22,418.16

 

The source of funds is the project budget as approved by the Board at the time of the Construction Contract Award.
