Title: IN1 Auto & General Liability Claims

Recommendation:

I recommend approval of continuation of representation by Mark Hendricks of Lydeckeer, Lee, Behar, et al for the following cases and authorize the Director of  Risk Management to execute all appropriate documents:

Description:

Outside legal services are obtained through RFP #03C022H, which sets the hourly rate, approves law firms and establishes handling guidelines.  These reassigned files will be governed by the terms and conditions of the RFP.

Mark Hendricks handles two Auto Liability and two General Liability cases for us on behalf of an approved firm, Panza, Maurer, et al.  He is leaving Panza, Mauer and will continue with Lydecker, Lee, Behar, el al. 

Mr. Hendricks has proven to be a competent attorney who has been defending and has full knowledge of the 4 cases at issue.  The District will be better served by using the same lawyer for handling of claims to conclusion rather than have the files reassigned.  The District will not extend any new assignments.

The work performed by this attorney to date, has met with approval of the District.

Financial Impact:
The financial  impact to the District will be the hourly rate charged by the attorney to complete defense of these claims as per the RFP.  The source will be the General Fund.
