Title: Spec. Mtg. re: Pupil Progression Plan Emergency Rule

Recommendation:
I recommend that the Board adopt the emergency rule, Policy 8.01-ER, entitled “Promotion, Placement and Graduation – Student Progression Plan,” and make the findings as set forth in the Board report.

Description:

This revision will incorporate the 2007-2008 edition of the District’s Student Progression Plans by reference, to supersede the 2006-2007 edition.  The revisions are intended to reflect recent changes in the law and to maximize consistency with state statutes, State Board of Education rules, and DOE practices regarding matters such as student performance standards, promotion, and graduation requirements for K-12, adult general education, special education, and dual enrollment.

 

This recommendation for adoption of an emergency rule is being made upon a finding as required by law for the welfare of the students because the Plans that were very recently modified need to be adopted immediately and incorporated into this rule as close as possible to the beginning of the school year, whereas regular rulemaking will take a couple of months.  Moreover, notice of this action is fair where the notice of the special meeting concerning this emergency rule is being posed on the District’s website, accessible to the public, on or about August 17, 2007, along with the agenda, the proposed policy changes, and copies of the Plans, and the required notice of the Board’s special meeting will be timely published in the newspaper.

 

The revised Plans are attached as an appendix to this Board report.

 

Regular development is also being recommended as soon as possible (anticipated to begin on September 12, 2007), and that process is likely to be completed before the emergency rule would expire on November 20, 2007.
