Title: IN1 General Liability /Joseph Finley as parent of Julianne Finley

Recommendation:
I recommend that the School Board approve the liability claim for Joseph Finley as parent of Julianne Finley, claim #JF 694544 in the amount of $100,000 representing compensation, attorneys' fees and costs and authorize the execution of all related documents.  This settlement will finalize all outstanding issues.

Description:

The Settlement of this claim was recommended by the District's outside counsel and claim adjusters and has been approved by the Chief Counsel, Chief Financial Officer and Director of Employee Benefits and Risk Management as required by District Policy #6.09.

A now 20 year old ESE student sustained multiple injuries when she injured on 10/7/04 after gaining access to an unauthorized mechanical room and an a/c chiller area  at Boca Raton HS.  She fell after climbing on the equipment.  Her injuries resulted a broken leg requiring surgery and rod placement.  Medical bills exceed $35,000.  We will include any liens.

 The settlement will extinguish all future liabilities.

Financial Impact:
The financial  impact to the District for this settlement is $100,000.  The source of funds is the General Fund.
