New Business - Charter Schools

Title: CS3-Second Amendment to the Charter for Palm Beach Military Academy

Recommendation:
I recommend that the School Board approve the second Amendment to the Agreement with Palm Beach Military Academy Charter School to defer opening of the Charter School to August 2006.

Description:

The School Board of Palm Beach County, Florida, ("School Board") and the Palm Beach Military Charter School, ("Charter School"), entered into an Agreement on April 21, 2005.

On June 29, 2005, the School Board approved the first Amendment from the Charter School to defer its opening date until January 1, 2006.

On December 5, 2005, the School Board received written correspondence from the Charter School, a copy of which is attached as Exhibit "A" to this Amendment, requesting that its opening date be deferred until August 2006.

The request was based upon the fact that a facility would not be available until that date.

There are certain provisions in the Charter Agreement that need to be extended based on the deferred opening date.  Those provisions are outlined in the first Amendment.

In the event of any conflict between the terms of the first Amendment and the Charter Agreement, the terms of the First Amendment shall control.

The Superintendent is authorized to take administrative action on delayed or deferred openings of Charter Schools.

Financial Impact:
There is no financial impact to the District
