NOTICE OF PROPOSED RULE ADOPTION
AND PUBLIC HEARING

RULE TITLE: Student Residence Enrollment Requirements.

RULE NUMBER: Policy 5.011.

PURPOSE AND EFFECT: The purpose of the policy is to facilitate student registration at the assigned school based on the primary residence, address overcrowding, and prohibit barriers to registration for families who lack certain documentation due to extenuating circumstances or hardship, as defined in the policy.

SUMMARY: This revision provides school assignments based on the primary residence of the student and a parent (if applicable). It does not apply to students with alternative approved assignments or to students experiencing homelessness or unaccompanied youth. Additional revisions include: procedures when language barriers exist for the parents during the registration process; proof of address requirements and documentation are revised to provide a process for enrolling the student and the District to follow if documentation is unavailable due to extenuating circumstances or hardship; the process and criteria for determining the appropriate school for children of divorced or separated parents and children living with persons acting as a parent; a separate process for students enrolled in extra-curricular training academies. The policy allows for the District to investigate situations if a reasonable suspicion exists that a student is not residing primarily in the attendance zone for the school and the school's ability to request additional documentation as specified within the policy. An appeal process exists for situations where the school determines that the student does not reside within the school's boundaries.

Any person who wishes to provide information regarding a statement of estimated regulatory costs, or to provide a proposal for a lower cost regulatory alternative, must do so in writing within 21 days of the publication of this Notice.

PUBLIC HEARING NOTICE: Adoption of the proposed rule is anticipated to be considered at the School Board's Special Meeting on Policies on June 6, 2012, anticipated to begin at 2:00 p.m. (an approximate time, as the actual start time may vary earlier or later) in the Board Chambers at 3300 Forest Hill Boulevard; West Palm Beach, Fla. AGENDA: An agenda will be available by May 30, 2012 on the District's Web site. Pursuant to the provisions of the Americans with Disabilities Act, any person requiring special accommodations to participate in this hearing is asked to advise the agency at least 48 hours in advance by contacting the Board clerk at 434-8139. A person may submit written comments (12 copies) about the proposed action to the clerk no later than the time of the public hearing. This hearing is open to the public.
